End User License Agreement

Thank you for using ZShot. ZShot is provided by Scale Assembly, LLC ("Scale Assembly"). This software tool is designed to help you access, capture, and view websites in a variety of different formats. We wrote this End User License Agreement (EULA) to clearly explain the rules, rights, and responsibilities that apply when you download and use our software.

Please read this document carefully. By downloading, installing, or using ZShot, you are agreeing to these terms. If you do not agree with them, please do not install or use the software.

You get a license, not ownership: We are giving you permission to use ZShot, but Scale Assembly retains all ownership of its own software.
Play by the rules: You cannot resell ZShot, offer it to others as a service, or bypass its licensing.
You are responsible for what you capture: You choose the websites ZShot accesses and the AI services it talks to, and you are responsible for those choices.
Scale Assembly doesn't receive your captures: ZShot processes web pages locally and never sends them to us automatically. Captures reach third parties only when you configure AI features or share them yourself.
We limit our liability: The software is provided "as is," and our financial liability if something goes wrong is strictly capped.
Open source is respected: ZShot ships with open-source components, including FFmpeg, and nothing in this agreement limits the rights those components' licenses give you.

1. License Grant

To use ZShot, you need our permission. We grant you a personal, worldwide, non-exclusive, non-transferable license to download, install, and use the ZShot software.

This license allows you to use ZShot for your personal or internal business purposes, to access, capture, and format websites as intended by the application. You may install and run the software on systems that you own, lease, or control, including virtual machines, containers, and continuous-integration runners. Because we serve a global customer base, this license is valid worldwide, subject to the export restrictions detailed later in this agreement.

ZShot's features are organized into license tiers. Without a license key, ZShot runs with its free feature set, and this agreement applies to that use too. A purchased license key unlocks the features of its tier; a trial key unlocks them for the trial period. Feature availability and the scope of use for each tier are described in the product documentation.

2. Restrictions

To protect our intellectual property and ensure ZShot remains a secure, stable platform for all users, there are certain things you cannot do with the software.

You agree that you will not:
Redistribute or resell: You may not sell, rent, lease, or sublicense ZShot to anyone else.
Offer ZShot as a service: You may not make ZShot's functionality available to third parties as a hosted or managed service, including by exposing its server mode or API to customers of your own. Deploying ZShot as an internal service within your own organization is permitted under your license tier. Delivering the outputs ZShot generates — screenshots, documents, archives, and other captures — to your own clients or customers is not reselling and is always permitted. If you would like to offer ZShot-backed services to others, contact us at support@zshot-app.com to arrange separate terms.
Modify or create derivative works: You may not alter the software or build new applications based on our code unless we explicitly give you written permission to do so, except as permitted by the licenses of the bundled third-party components described in Section 9, or to the extent such a restriction is prohibited by applicable law.
Bypass licensing: You may not circumvent ZShot's license enforcement, tamper with license validation, or use a license key beyond the terms of its tier.
Share license keys: License keys are for the licensee they were issued to. You may not publish them or provide them to others.

Nothing in this section restricts any right granted to you by the open-source licenses of ZShot's bundled third-party components (see Section 9).

3. Ownership

Clarity around who owns what helps prevent misunderstandings.

Software Ownership

Scale Assembly owns all rights, title, and interest in and to ZShot's own software. This includes all copyrights, patents, trademarks, and trade secrets related to it. Downloading the application does not transfer any ownership rights to you. This ownership does not extend to the third-party and open-source components ZShot ships with, which remain the property of their respective owners (see Section 9).

Your Data

You retain full ownership of any personal data or content you process through ZShot. We do not claim ownership over the websites you access or the captures you generate using our tool.

Feedback

We love hearing how we can improve. If you send us feedback, suggestions, or feature requests, you grant us the right to use those ideas to improve ZShot without any obligation to compensate you.

4. Acceptable Use

ZShot captures third-party websites at your direction, and you are responsible for how you direct it.

You are responsible for ensuring you have the right to access and capture the websites you point ZShot at, and for complying with applicable laws and any terms that govern those websites. ZShot honors robots.txt by default; where your license tier permits disabling protections, doing so is your decision and your responsibility. You are likewise responsible for the captures you create, including how you store, share, and use content that may be protected by copyright or other rights.

5. AI Features

Some ZShot features can connect to AI model services — for formatting captured content or for navigating pages toward a goal.

These connections are configured by you — hosted providers, custom endpoints, or local models — using your own accounts and API keys, and are governed by your agreements with those providers. Depending on the features and provider you configure, ZShot may transmit prompts, page text, screenshots or other page content, and related request data to that provider or endpoint. Some providers may execute additional tools or network requests of their own, outside ZShot's control and outside its robots.txt and URL protections.

Automated navigation can have external effects: an AI-driven session can click buttons, submit forms, and trigger actions on the sites it visits. You are responsible for authorizing those effects. Scale Assembly is not a party to your provider agreements, does not warrant AI output, and is not liable for actions taken by AI models when using ZShot, including the navigation steps a model chooses to perform.

6. Updates & Support

Software is a living thing, and we actively maintain ZShot to ensure it works well for you.

We may periodically release updates to add new features, fix bugs, or enhance security. Depending on how you installed ZShot, updates may be applied automatically: the ZShot Mac application includes an automatic updater, and package managers such as APT and Homebrew may update ZShot as part of their own update mechanisms. The standalone command-line binary does not update itself; you choose when to install new releases. While we strive to maintain backward compatibility with older operating systems, we cannot guarantee that ZShot will forever support legacy hardware or software.

7. Privacy & Data

ZShot processes web pages locally on your machine. It does not automatically transmit captured pages or generated files to Scale Assembly. If you voluntarily provide captures, diagnostics, logs, or other files to us for support, we will receive and process the information you choose to provide.

ZShot contacts our licensing server to activate, validate, and refresh license keys. That exchange includes your license key, a machine identifier, your machine's hostname, and the ZShot version. Purchases may be processed by our authorized merchant of record, currently Lemon Squeezy, under its own buyer terms and privacy policy, and our services run on cloud infrastructure providers.

ZShot disables all telemetry we are aware of in its underlying browser components. We do not take responsibility for third-party components, or for the web pages you access, including any telemetry of their own.

You have the right to access the personal data we hold about you, correct inaccuracies, and request deletion. Your applicable privacy rights, and comprehensive details on how we collect, use, and protect your information, are described in our Privacy Policy at https://zshot-cli.com/support/privacy_policy/.

8. Termination

This agreement remains in effect until terminated as described in this section.

You can terminate this agreement at any time by ceasing to use ZShot, uninstalling it, and destroying all copies of the software in your possession. We may terminate this agreement and revoke your license key if you materially breach these terms, circumvent license enforcement, or if the purchase of your license is refunded or reversed.

Upon termination, your license to use ZShot ends immediately. You must stop using the software and delete it from your systems. License records are retained as described in our Privacy Policy.

9. Third-Party and Open-Source Components

Modern software relies on shared foundations. ZShot includes third-party and open-source software components, including the Chromium Embedded Framework and the FFmpeg libraries.

These components are licensed to you under their own terms and conditions, which take precedence over this EULA strictly regarding your use of those specific components. You can find the attribution list, copyright notices, and license terms by running `zshot --open-source-licenses`, or in the About window of the ZShot Mac application.

FFmpeg: This software uses libraries from the FFmpeg project under the LGPL v3. FFmpeg is an open-source project with its own license and is not owned in any way by Scale Assembly; its owners can be found at https://ffmpeg.org. The corresponding FFmpeg source code, the exact build configuration, and instructions for substituting your own FFmpeg libraries are provided by `zshot --open-source-licenses`. Nothing in this EULA restricts the rights the LGPL grants you with respect to the FFmpeg libraries, including modifying them and replacing the copies ZShot uses.

10. Warranties & Disclaimers

We have built ZShot with care, but we cannot promise it will be perfect 100% of the time. ZShot was developed in part with the assistance of large language model (LLM) coding tools, and by using ZShot you acknowledge that. Nothing in this agreement excludes or limits any liability or consumer right that cannot lawfully be excluded or limited.

"As Is" Delivery

ZShot is provided on an "AS IS" and "AS AVAILABLE" basis. Scale Assembly expressly disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the software will be error-free, completely secure, or operate without interruption.

Limitation of Liability

To the maximum extent permitted by law, Scale Assembly shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of ZShot, including damages arising from the websites you capture or the AI services you connect.
Furthermore, our total liability for any direct damages arising under this agreement shall be strictly capped at the total amount paid for the applicable ZShot license in the twelve (12) months preceding the event giving rise to the claim, or one hundred US dollars ($100.00), whichever is greater. This cap is a fundamental element of the basis of the bargain between you and Scale Assembly.

11. Indemnification

You agree to indemnify and hold Scale Assembly harmless from third-party claims arising out of your use of ZShot in violation of this agreement, including claims arising from the websites you capture or the content you produce.

12. Export Control and Sanctions

ZShot is subject to international export control laws.

By downloading and using ZShot, you agree to comply strictly with all applicable export laws and regulations, including the U.S. Export Administration Regulations (EAR). You represent and warrant that you are not located in, under the control of, or acting on behalf of anyone in an embargoed country or a region subject to comprehensive U.S. sanctions. Furthermore, you confirm you are not listed on any U.S. government list of prohibited or restricted parties.

13. U.S. Government End Users

If you are affiliated with the U.S. Government, this section applies to you.

ZShot and its related documentation are considered "commercial computer software" and "commercial computer software documentation" as defined in FAR 12.212 and DFARS 227.7202. Any use, modification, reproduction, release, performance, display, or disclosure of the software by the U.S. Government is governed solely by the terms of this EULA. Government users acquire only the exact same rights granted to all other end users.

14. General

A few final legal housekeeping items:
Severability: If any part of this agreement is found to be unenforceable by a court, the rest of the agreement will remain in full effect.
Assignment: You may not transfer or assign this license to anyone else. Scale Assembly may assign our rights and obligations under this agreement to another company in the event of a merger or acquisition.
Survival: The sections regarding Restrictions, Ownership, Acceptable Use, Warranties & Disclaimers, Indemnification, and Governing Law will survive even after this agreement is terminated.
Entire Agreement: Except where you and Scale Assembly have signed a separate written agreement covering ZShot, this EULA represents the entire agreement between you and Scale Assembly regarding your use of the ZShot software, superseding any prior agreements.

15. Governing Law

This agreement is governed by the laws of the State of Indiana, USA, without regard to its conflict of law principles. However, if you are a consumer residing in the European Union, the United Kingdom, or another jurisdiction with mandatory consumer protection laws, nothing in this agreement deprives you of the protection afforded to you by the mandatory laws of your country of residence.
